The apparent disparity of opposition within the different branches of law is not an obstacle to the unity of this notion. Oppositions actually follow a common operating mode. They act as means of conservatory defence in order to protect the owner's legal interests, in situations when these interests might be at stake. Indeed, other people's legal activities are likely to affect the opponent's interests, in spite of being third party. In this respect, opposition is a legal certificate, depending on whether the protection of the opponent's interests results in the cancellation of the certificate or in the alteration of a part oof its effects only. Opposition represents the shift from an unsteady situation to a steady situation and thus contributes to the regulation of legal relationships in the course of time.
La disparité apparente de l'opposition au sein des différentes branches du droit ne fait pas obstacle à toute unité de la notion. Les oppositions obéissent effectivement à un mode opératoire commun. L'opposition agit comme un moyen de défense conservatoire afin d'assurer la sauvegarde des intérêts légitimes de son titulaire, dans les situations où ceux-ci risquent d'être compromis. L'activité juridique d'autrui est en effet susceptible de porter atteinte aux intérêts de l'opposant, en dépit de sa qualité de tiers. A cet égard, l'opposition consiste en une manifestation unilatérale de volonté, destinée à neutraliser tout ou partie des effets d'un acte juridique, selon que la protection des intérêts de l'opposant commande la disparition de l'acte ou seulement l'altération d'une partie de ses effets. L'opposition marque le passage d'une situation fragilisée à une situation stabilisée et participe ainsi à la régulation des relations juridiques dans la durée.
