RÉFLEXIONS SUR L'ÉVOLUTION RÉCENTE DE LA PROTECTION ET DE LA VALORISATION DU PATRIMOINE NUMÉRIQUE DES COLLECTIVITÉS PUBLIQUES
Résumé
The legal regime governing the digital heritage properties of public authorities gives rise to many hesitations. The legislator has only established this regime in respect of property in national domains. In ruling on this regime, the constitutional court was able to identify two general interest objectives of protecting and enhancing the value of these assets. If the affirmation of the first was expected, without however not failing to raise legal questions, this objective cannot be understood without the confirmation of the second valuation objective. Nevertheless, the question of extending this regime beyond national domains remains fully raised.
Le régime juridique des biens du patrimoine numérique des collectivités publiques donne lieu à de nombreuses hésitations. Le législateur n'a fixé ce régime qu'à propos des biens des domaines nationaux. Statuant sur ce régime, le juge constitutionnel a pu dégager deux objectifs d'intérêt général de protection et de valorisation de ces biens. Si l'affirmation du premier était attendue, sans toutefois ne pas manquer de soulever des questions juridiques, cet objectif ne peut être compris sans la confirmation du second objectif de valorisation. Il n'en reste pas moins que la question de l'extension de ce régime au-delà des domaines nationaux demeure entièrement posée. Mots-clés :
