Convient-il de breveter les gènes ? Une analyse économique

The costs, in terms of inhibiting further research and innovation, of patenting genes, are larger than the benefits, in terms of added incentives to the effort of identifying genes ; it is thus economically detrimental to patent genes. For those which are already patented, compulsory licensing should be viewed as analogous to regulating the access to essential facilities in network utilities.

Les inconvénients, en particulier pour le développement de la recherche et de l'innovation, de breveter les gènes pèsent plus lourds que les avantages ; il faut par conséquent, d'un point de vue économique, ne pas breveter les gènes. Là où le mal est fait, il faut, quand cela s'avère opportun, utiliser les licences obligatoires, comme on régule les infrastructures essentielles dans les services publics en réseaux.
