The Special Basque Language of the Law. A Linguistic and Terminological Investigation on Terminology of a Translated Legal Corpus.

Basque language historically has not had a formal legal use, but in 1936-1937, and from 1978 to the present time, Basque language became an official language, along with Spanish, in a part of the country.
The aim of this dissertation is to bring to light the linguistic procedures used to express in Basque language the present legal realities. More exactly, the study of the creation of a special language, the legal language, through the units with terminological value contained in translated legal Basque texts published in the Official Gazette of the Basque Country along with their original texts in Spanish.
The different procedures for terminological and lexical creation are widely studied. Although the proportions vary from text to text, all typical procedures are found. The ones based on pre-existing materials of the language itself, like derivation, composition, as well as turning Basque common words into legal terms, and the procedures consisting of contributions of other languages, mainly Spanish, through lexical borrowing and translation loans.
A very fast evolution of the language, as well as great differences between times can be stated. We can affirm that in 1997, the last year of the analysed corpus, numerous legal texts exist, in some cases with high level of specialty, provided with a moderately coherent terminology. That is to say, we can speak of the existence of a legal language in Basque language.

La langue basque n'a historiquement jamais eu d'emploi formel dans le champ du droit, mais en 1936-37 et depuis 1978, elle est devenue officielle, en meme temps que l'espagnol dans une partie du Pays Basque.
Le but de cette thèse est de montrer les differentes procedés linguistiques qui ont permis à la langue basque d'exprimer les réalités juridiques actuelles, et plus concretement, d'étudier le procés de création d'une langue d'espécialité, la langue du droit, à travers les unités à valeur terminologique extraites des textes des lois publiées au Bulletin Officiel du Pays Basques; textes traduits et publiés en colonnes avec ses originaux en espagnol.
La thèse étudie les diferentes procedés employées pour la creation lexicale et terminologique en ces textes. Les proportions sont diverses entre eux, mais tous les procédés typiques s'y trouvent toujours: soit ceux qui employent des materiaux preéxistants dans la langue comme la dérivation, et la composition, soit la terminologisation de mots communs de la langue, soit les procedés néologiques consistants à prendre des materiaux d'autres langues à travers le calque ou le prêt linguistiques.
Cette étude permet de constater une evolution très rapide du lexique basque, et des grands écarts entre textes de differentes périodes. Nous pouvons affirmer qu'en 1997 dernière année des textes analisés, il existe en basque de nombreux textes juridiques qui en certain cas ont un niveau de spécialité très haut, et qui employent en genéral une terminologie juridique assez coherente. On peut desormais parler d'un langue basque de spécilité juridique.
