Des militants anti-glyphosate épargnés en première instance

On the grounds of necessity, the judicial court in Foix acquitted anti-glyphosate activists (members of the Ariège anti-GMO volunteer reapers) who, in 2016, sprayed paint on herbicide products (Roundup) sold in shops in Foix and Pamiers. The court ruled out the application of article 222-3 of the French Penal Code, which provides for 5 years' imprisonment and a fine of €75,000 for collective damage to other people's property, as the defendants' action was justified by a state of necessity (article 127-7 of the Penal Code). However, an acquittal on this basis is not legally defensible. However, as the court considered that the actions in question were intended to inform the public, it had all the elements to justify, boldly, acquitting the accused on the grounds of freedom of expression, i.e. on the basis of article 10 of the European Convention on Human Rights.

Le tribunal judiciaire de Foix relaxe, au nom de l’état de nécessité, des militants anti-glyphosate (appartenant aux faucheurs volontaires anti-OGM ariégeois) qui avaient en 2016 badigeonné de peinture des produits herbicides (Roundup) vendus dans des magasins de Foix et Pamiers. L’application de l’article 222-3 du Code pénal, punissant de 5 ans d’emprisonnement et 75 000 euros d’amende la dégradation en réunion des biens d’autrui, est écartée par le tribunal, qui juge l’action des prévenus justifiée par l’état de nécessité (art. 127-7 du Code pénal). Une relaxe à ce titre n’est pourtant pas juridiquement défendable. Pour autant, le tribunal ayant estimé que les actes litigieux visaient à informer la population, il avait tous les éléments pour justifier, audacieusement, la relaxe au nom de l’exercice de la liberté d’expression, c’est-à-dire en s’appuyant sur l’article 10 de la Convention européenne des droits de l’homme.
