Du « religieux » à « l’utilité publique » ; droit canonique et sécularisation du XVIe au XXe siècle

Ohne die Untersuchungen der Rechtshistoriker, die sich mit den kirchenrechtlichen Ursprüngen zahlreicher Institutionen beschäftigen, außer Acht zu lassen, will dieser Artikel aufzeigen, wie religiöser Charakter und öffentlicher Nutzen zwei Aspekte zahlreicher Realitäten sind, sowohl aus kirchenrechtlicher als auch aus säkularrechtlicher Sicht und bezogen auf das moderne Zeitalter und das 19. und 20. Jahrhundert. Ein Zusammenwirken des Religiösen und des öffentlichen Nutzens die Lage des Individuums betreffend, insbesondere den Ehestand oder die Verfolgung von Häresie, Blasphemie und Sakrileg. Ein Vergleichsspiel zwischen diesen zwei gleichen Registern betreffende Güter, Patrimonium, Quellen von Reichtum, Immobilien und Objekte, die der unmittelbaren Ausübung des Kultes dienen. Wenn die Existenz einer allgemeinen Säkularisationsbewegung eine Selbstverständlichkeit ist, so muss man diese Evolution doch analysieren unter Berücksichtigung der Stellung, die das Kirchenrecht gegenüber dem öffentlichen Nutzen und dem allgemeinen Interesse eingenommen hat, aber auch unter Berücksichtigung des Konzeptes des Heiligen, das regelmäßig vom säkularen Recht vermittelt wird.
Without ignoring the historical research on law that focuses on the canonical origins of multiple institutions, this article aims to show how religious nature and public utility are all but two facets of numerous realities, as is understood by canon law as well as secular rights, in the modern era and the 19th through the 20th century. The religious concomitance and public utility regarding the status of individuals, including their marital status or heretical prosecution, are taken into account, especially blasphemy and sacrilege. A comparison is made between the same two ranges with respect to property, sources of wealth and buildings and objects used directly for worship. If the existence of a general movement of secularization is obvious, it is then necessary to analyze this evolution, taking into account the space constantly afforded by canon law. This is in regard not only to the public utility and the general interest, but also to the sacred and holy notions regularly conveyed by secular rights.
Sans ignorer les recherches des historiens du droit s’attachant aux origines canoniques de nombreuses institutions, cet article se propose de montrer comment le caractère religieux et l’utilité publique sont deux facettes de nombreuses réalités, appréhendées tant par le droit canonique que par les droits séculiers, à l’époque moderne et au 19e voire au 20e s. Concomitance du religieux et de l’utilité publique en ce qui concerne la condition des individus, notamment leur état matrimonial ou la poursuite de l’hérésie, du blasphème et du sacrilège. Jeu comparable entre ces deux mêmes registres pour ce qui a trait aux biens, patrimoine source de richesse ou immeubles et objets servant directement au culte. Si l’existence d’un mouvement général de sécularisation est une évidence, il convient d’analyser cette évolution en tenant compte de la place constamment faite par le droit canonique à l’utilité publique ou à l’intérêt général, mais aussi des notions de sacré ou de saint, régulièrement véhiculées par les droits séculiers.
