The grey zone and labour market dynamics in Germany: new regulations and new ways of using employment categories. Self-employment and traineeships

In this article, we define the grey zone' as the proliferation of categories of employment and the growing dissonance between those categories and the realities of the labour market. Against the background of the weakening of the standard employment relationship, and going beyond the dualism of the labour market, there are three processes by which the employment norm is differentiated: the institutionalisation of new employment categories by public authorities, the influence of collective norms on the framing of employment categories by organised groups such as unions and employers' associations, and the uses of those norms by social actors such as companies. In this article, we first describe the evolution of the German labour market over the past 20 years. We then shed light on the dynamics of the grey zones of employment in Germany by drawing on two strands - self-employment and traineeships - and by distinguishing the three differentiation mechanisms. Dans cet article, nous definissons la << zone grise >> comme etant la proliferation des categories d'emplois et la discordance croissante entre ces categories et les realites du marche du travail. Dans le cadre de l'affaiblissement de la relation d'emploi standard et au-dela du dualisme du marche du travail, on peut observer un triple processus de differenciation de la norme d'emploi: l'institutionnalisation de nouvelles categories d'emplois par les pouvoirs publics, l'influence des normes collectives sur la categorisation de l'emploi effectuee par des groupes organises tels que les syndicats et les associations d'employeurs, et l'utilisation de ces normes par des acteurs sociaux tels que les entreprises. Dans cet article, nous decrivons d'abord l'evolution du marche du travail allemand au cours des 20 dernieres annees. Nous mettons ensuite en lumiere la dynamique des zones grises de l'emploi en Allemagne en examinant deux axes - le travail d'independant et les stages - et en distinguant les trois mecanismes de differenciation. Im vorliegenden Artikel definieren wir mit dem Begriff Grauzone die Ausbreitung neuer Beschaftigungskategorien und die damit einhergehende zunehmende Dissonanz zwischen diesen Kategorien und den Realitaten des Arbeitsmarktes. Vor dem Hintergrund des Bedeutungsverlustes standardisierter Beschaftigungsverhaltnisse und jenseits des Dualismus des Arbeitsmarktes gibt es drei Prozesse, durch die die Beschaftigungsnorm differenziert wird: die Institutionalisierung neuer Beschaftigungsformen durch die Behorden, der Einfluss kollektiver Normen auf die Konzeption von Beschaftigungskategorien durch organisierte Gruppen wie Gewerkschaften und Arbeitgeberverbande, und die Verwendung dieser Normen durch gesellschaftliche Akteure wie Unternehmen. In diesem Artikel beschreiben wir zunachst die Entwicklung des deutschen Arbeitsmarktes wahrend der vergangenen zwanzig Jahre. Danach betrachten wir die Dynamik der Beschaftigungs-Grauzonen in Deutschland, indem wir von den beiden Schwerpunkten Selbstandigkeit und Praktika ausgehen und dabei die drei oben genannten Differenzier-ungsprozesse einzeln beschreiben.
