Recherche sur le conseiller-commissaire au parlement de Flandre

Abstract : In lack of research instrument of the sub-series 8 B 1 of the archives of the North of France, most of the scientific writings on the sovereign council of Tournai, then of the parliament, had until now been based on the analysis royal edicts and ordinances and on some historical or doctrinal works. Today more accessible, this sub-series, where are mainly kept the records of court proceedings, is rich in information. Through these files, all the activity upstream of the judgement phase is revealed to the researcher. They give new light on the legal literature of the late XVIIth and XVIIIth centuries. They highlight the role of the adviser-commissioner in the procedure. Indeed, applied to a large number of pieces of various types and origins, a lexicographic analysis made it possible to draw up the status and functions of the adviser-commissioner. To draw this portrait, it was necessary to find the meaning of words in the vocabulary of sources. Inductive research, by giving meaning to words or phrases that are often misunderstood, has made it possible to trace the prevailing conditions to the choice of the first advisers of the court, the honour and dignity attached to the position of adviser-commissioner have been cleared. The central position of the adviser-commissioner in the procedure emerged from the exploited sources, and the actual modalities of the work of the adviser-commissioner emerged.
