Ethics Committees in the Health System: institutionalizing transgression?
Structures éthiques en santé : institutionnaliser la transgression ?

In a context where health professionals are in a permanent search of meaning, ethical committees can be its original leaders or incubators. However they have to cope with an ontological dilemma, which relies on the dialectic ethic/organization. The match between ethics with its quality of thinking alternatively, and an organizational system grounded on rationalizing and regulating appears to be inherently contradictory. Our purpose is to focus pragmatically on this tension. We want to emphasize that this dialectic finds a resolution thanks to two strategies, the first one being a shift from authority to authorship, with a collective malleability of the texts for practices and the second one, the rehabilitation of flexibility.
Dans un contexte où les pratiques du soin semblent dans une quête de sens permanente, les structures éthiques apparaissent comme des moteurs à cette création du sens. Toutefois, la rencontre entre une éthique, qui ne se conçoit qu’à l’orée d’une capacité à penser autrement, et une mécanique organisationnelle fondée sur une rationalisation et une régulation administrée, paraît dans les termes conflictuelle. Notre article se concentre sur cette tension, dans son appropriation pratique par les acteurs des dispositifs éthiques. Nous faisons l’hypothèse que le potentiel transgressif de ces structures se mesure par les formes communicationnelles qu’il met en jeu, initiant une forme de moralité distribuée et une malléabilité des pratiques.
