Indemnities in Diplomacy

Résumé

Requests for indemnity for injuries suffered by aliens frequently arise as part of the exercise of diplomatic protection. Based upon this institution, an injured person's state of nationality presents a claim against the state alleged to be responsible for that injury, with a view to obtaining reparation. The customary law that governs this sphere of international law was collected and codified by the International Law Commission in two Draft Articles, formally adopted in 2001 and 2006. After proposing a brief historical account, this entry focuses on an overview of the topic in current international law based on the norms established in the two Draft Articles.
