La naissance du tribunal pour enfants. Une comparaison France-Québec, 1912-1945

Abstract :

«The Birth of the Juvenile Courts in Angers and Montreal (1912-1940)». At the beginning of the XXth Century, the issue of neglected and abandoned children gained ground in industrialised countries, both in Europe and North America. In the more general context of the development of the Social State, people became increasingly concerned about the care of these children. Beyond such concepts as delinquent, «guilty» or «vicious» children, social actors in the area of juvenile deviance put forward the idea of children «in moral danger», who are in need of protection. This was at the root of a specific legal orientation for juveniles, where juvenile courts held a key position. Liberal ideology was being challenged and States gave themselves the right to intervene in families, thus far viewed as sacrosanct. Families from popular classes were regarded as sometimes failing to fulfil their educative and socialising role. Our intention is to look at the history of social regulations, to grasp the development of child protection policies within that field, as well as to understand how families and youths reacted to these new public courses of action. Beyond what remains particular to each milieu, we wish to understand how Quebec and France – two nations sharing common roots but with different legal and political systems – looked at the issue of youth in difficulty, a problem that generated fears and expectations in societies that were at the dawn of a mass democracy era. This new juvenile justice was at the roots of the decriminalisation process of juvenile delinquency, the psycho-educative approach to young offenders, as well as the educative assistance for families considered as problematic – approaches that are now hotly debated on Western political scenes.
