Le concept de "constitution économique" : une analyse critique

Abstract : The market is one of the institutional forms of exercise of power in the Union. This form has sometimes been systematized by some jurists with reference to the concept of “economic constitution”, which has had some success in recent years. Yet the meaning of the concept is far from being monolithic. The present study sets out to review the political conditions of its appearance in Germany and the use that could be made of it in the doctrine, from the origins of Community law to more recent developments related to the economic and financial crisis. The concept has been used by communitarian doctrine in a sense directed towards a certain idea of economic federalism; the latest developments in the economic and financial crisis are challenging the traditional meaning of reference to economic governance.
