La censure de la loi Alfano par la Cour constitutionnelle italienne

Abstract : The main purpose of the chronicle devoted by the journal Constitutions to the judicial function will be to report on the current events concerning the role and place of judges in the institutional and normative system, whether they are French, foreign, European or international. However, it will not rule out theoretical analyses, which are always indispensable for understanding political and legal realities. There will be a great emphasis on comparatism, and it is through this focus that this first chronicle begins, devoted to the commentary on the decision of the Italian Constitutional Court of 7 October 2009 censoring the so-called "Alfano" law establishing temporary judicial immunity for the holders of the four highest political offices of the Italian State. The reader will certainly know how to draw a useful comparison of the solutions adopted in French positive law.
