L'égalité entre les femmes et les hommes dans l'emploi : réflexions sur l'évolution récente du droit français

Abstract : Gender Equality in the Employment Sector : Reflections on the Recent Evolution of French Law The principle of equality has a particular status in labor law in that it effectively consists of the right to subordination par excellence. The notion of “justified discrimination” was cleared by the jurisprudence of the Council of State and the Constitutional Council. Is it transposable into labor law ? In order to analyze the complex notion of equality between sexes in the workplace, I shall examine the normative conception of case law. Furthermore, current legal and political trends lead us to question the position of the executive and legislative branches in relation to the rules laid down by the Court of Cassation, as well as the rules shared with the European judge, regarding equality between male and female employees.
