Le cadre juridique international de la lutte contre le trafic maritime de stupéfiants : Quelles compétences pour les Etats ?

Abstract : Does the international legal framework progressively established over the last century allow States to effectively tackle drug trafficking by sea? Nothing could be less certain, taking into consideration legal and operational difficulties encountered until now, even if headway was made these last few years. State competences vary considerably according to the maritime areas concerned, and these form a vast space whose access remains often difficult. By specifying the powers of States in these various spaces, the United Nations Convention on the Law of the Sea (1982) constitutes, together with the Vienna Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (1988), the legal basis of international cooperation in the field of the fight against maritime drug trafficking. Despite its multilateral character, this UN legal framework proves insufficient (I) and it is only through the conclusion of bilateral or regional agreements that some progress in the implementation of international cooperation in the various maritime areas was made possible (II). But to achieve more convincing results, undoubtedly it is today necessary to redefine this legal framework in order to find a better balance between the fundamental principles of the law of the sea and the requirements of the fight against narcotrafficking (III).
