Le droit des personnes intersexuées – Chantiers à venir – 2e partie

Abstract : Which rules should be established in France in order that the rights of intersex persons be respected, especially right to physical integrity expressed in article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms ? That is the question this article is trying to answer to, after having shown the unlawfulness of many medical acts that are today performed on intersex persons. In order to ensure the respect of such a right this article propose to modify the norms which encourage the medical practitioners to perform unlawful act and to modify the national healthcare policy on this question. Moreover, this article argues that a compensation scheme should be created in order to compensate the loss suffered by intersex persons who received unlawful “treatment”. In deed the traditional mechanism of tort law appears to be insufficient in order to compensate such losses
