Le concept constitutionnel de « représentation équilibrée des territoires » pour l'élection des assemblées locales

The constitutional private bill adopted by the French Senate on the 3rd of February 2015 aims at "improving the representation of the citizens" by combining a "democracy of the number and that of the territory". According to the authors of this text "if the equality of the vote establishes one of the main pillars of our democracy, its application cannot ignore the territorial fact which, through the geography and the history, is at the heart of the identity of our Nation" , involving in particular rural territories. Our communication will analyse this text which aims, on one hand, to dedicate the principle according to which "the Republic guarantees the fair representation of its territories in their diversity" (art.1 C. 1958) and, on the other, to reconcile the rule of political representation released by the Constitutional Council established for the main part on a demographic criterion with the rule of "fair representation of territories" based on the "territorial fact" (art. 72 C.).

La proposition de loi constitutionnelle adoptée par le Sénat français le 3 février 2015 vise à « améliorer la représentation des citoyens » en combinant « démocratie du nombre et celle du territoire ». Selon les auteurs de ce texte, « si l'égalité du suffrage constitue l'un des principaux piliers de notre démocratie, son application ne peut ignorer le fait territorial, qui à travers la géographie et l'histoire, est au cœur de l'identité de notre Nation » s'agissant notamment des collectivités territoriales rurales. Notre communication analysera ce texte qui vise, d'une part, à consacrer le principe selon lequel « la République garantit la représentation équitable de ses territoires dans leur diversité » (art. 1 C. 1958) et, d'autre part, à concilier la règle de représentation politique dégagée par le Conseil constitutionnel, suivant pour l'essentiel un critère démographique avec la règle de « représentation équitable des territoires » fondée sur le « fait territorial » (art. 72 C.).
