Juridiquement parlant, la révision en 2003 de la Constitution roumaine de 1991 n'était pas indispensable, elle permettait simplement une adéquation plus aisée entre acquis communautaire et Constitution nationale. Elle n'aurait d'ailleurs pas posé de problème majeur, tant le consensus en faveur de l'intégration européenne était massif dans la classe politique comme au sein de l'opinion. Toutefois, le contexte international et intérieur transforma une formalité en révélateur du retard et du dysfonctionnement de la transition. A l'extérieur, Bucarest devait réparer la fissure avec l'axe Paris-Berlin consécutif à la guerre d'Irak. A l'intérieur, le gouvernement devait relancer une popularité minée par la crise persistante et la corruption, car la révision constitutionnelle ne pouvait s'acquérir que par voie référendaire ou par voie parlementaire à la majorité des deux tiers. |

Legally speaking, the 2003 revision of the Romanian Constitution of 1991 was not essential, it merely allowed an easier fit between Constitution and the European "acquis". It would also not pose any major problem, as the consensus in favor of European integration was massive in the political class as in the opinion. However, the internal and international context turned a formality into a revealer of the delay and the failure of the transition. Outside, Bucharest had to repair the break with the Paris-Berlin axis following the war in Iraq. Inside, the government should boost popularity undermined by the continuing crisis and corruption, since the constitutional revision could be acquired only through a referendum or by parliamentary vote to two-thirds majority. |
