La proprieté intellectuelle dans les biotechnologies agricoles : Quels enjeux pour quelles perspectives ?

Within the framework of agricultural biotechnologies, there was an evolution of the intellectual property rights : the implementation of the patents on living organism, the evolution of the legislation on the Plant breeder's right from the Union for the Protection of plant varieties, or the implementation of intellectual property rights at a world level within the framework of Trips agreements (Article 27/3 B.) of WTO. In this context of evolutionary intellectual property rights, the markets of the agricultural genetic resources is based on goods and services related to the management of agro biodiversity. The markets related to the genetic resources will depend on the way in which the actors will jointly reach : technologies ; biological and genetic material; information and knowledge as well on the material as on technologies; agricultural markets that it is on a local, national, regional or world level. This is why in this paper we will analyze, whatever the statute of the genetic resources is, the conditions of access to the biological materials, the innovations and the markets and their consequences on the activities of research and development in the field of agricultural biotechnologies.

Dans le cadre des biotechnologies agricoles, il y a eu une évolution des droits sur la propriété intellectuelle que ce soit la mise en œuvre des brevets sur le vivant, l'évolution de la législation sur le Certificat d'Obtention Végétale de l'Union pour la Protection des Obtentions Végétales en 1991, ou la mise en œuvre de droits de propriété intellectuelle au niveau mondial sur les variétés végétales dans le cadre des accords ADPIC (art. 27/3 b.) de l'OMC.Dans ce contexte de droits de propriété intellectuelle évolutifs, les marchés des ressources génétiques à usage agricole reposent sur des biens et sur des services liés à la gestion de l'agro-biodiversité. Les marchés liés aux ressources génétiques vont dépendre de la manière dont les acteurs vont accéder conjointement à des technologies ; à du matériel biologique et génétique ; à des informations et à des connaissances tant sur le matériel que sur les technologies ; à des marchés agricoles que ce soit à un niveau local, national, régional ou mondial.C'est pourquoi dans ce papier nous allons analyser, quel que soit le statut des ressources génétiques, les conditions d'accès aux matériels biologiques, aux innovations et aux marchés et leurs conséquences sur les activités de recherche et de développement dans le domaine des biotechnologies agricoles.
